Proposal for EU regulation for batteries and waste batteries approved – reporting to member states

The Batteries and Waste Batteries Regulation contains a number of significant changes, including a change in reporting to Member States.
The Regulation defines minimum data reporting requirements in Article 75. Both producers and producer responsibility organizations will have to adapt their record-keeping to the new requirements and report the newly required data in a new classification according to the chemical composition of the batteries and a new categorization.
PORTABLE AND LMT BATTERIES
Producers of portable batteries and LMT batteries and, where applicable, producer responsibility organizations shall report the following information by chemical composition and category of batteries and waste batteries for each calendar year:
- the amount of portable batteries and LMT batteries made available on the market for the first time in the territory of a Member State
- he amount of portable batteries of general use made available on the market for the first time in the territory of a Member State
- the amount of waste portable batteries and waste LMT batteries collected
- the collection rate reached by the producer or producer responsibility organization for waste portable batteries and waste LMT batteries
- the amount of collected waste portable batteries and waste LMT batteries delivered to permitted facilities for treatment
- the amount of collected waste portable batteries and waste LMT batteries exported to third countries for treatment, preparation for re-use or preparation for repurposing
- the amount of collected waste portable batteries and waste LMT batteries delivered to permitted facilities for preparation for re-use or preparation for repurposing
SLI BATTERIES, INDUSTRIAL BATTERIES AND ELECTRIC VEHICLE BATTERIES
Producers of SLI batteries, industrial batteries and batteries for electric vehicles and, where applicable, producer responsibility organizations shall report information by chemical composition and categories of batteries and waste batteries for each calendar year:
- the amount of SLI batteries, industrial batteries and electric vehicle batteries made available on the market for the first time in a Member State
- the amount of collected waste SLI batteries, waste industrial batteries and waste electric vehicle batteries delivered to permitted facilities for preparation for re-use or preparation for repurposing
- the amount of collected waste SLI batteries, waste industrial batteries and waste electric vehicle batteries delivered to permitted facilities for treatment
- the amount of collected waste SLI batteries, waste industrial batteries and waste electric vehicle batteries exported to third countries for preparation for re-use, preparation for repurposing or for treatment
Reporting on the recycling efficiency and recovery of materials shall cover all individual steps of recycling. Where recycling operations are carried out at more than one facility, the first recycler shall be responsible for collecting the information and reporting that information to the competent authorities.
Producers or producer responsibility organizations, waste management operators and waste holders referred to in this Article shall report within six months of the end of the reporting year for which the data are collected. The first reporting period shall concern the first full calendar year after the entry into force of the implementing act that establishes the format for reporting to the Commission.
The European Council formally approved the text of the Regulation and its publication in the Official Journal of the EU took place on 28.7.2023, which means that the Regulation enters into force on 17.8.2023 and the individual provisions will enter into force gradually.
A timetable of the individual obligations set out in the new regulation, which will come into force gradually, is being prepared.
